Cool, but inaccurate. From my understanding of the Mortengaler decision, what is inside a woman’s uterus is not a person until it is born alive. That is why when a child dies in childbirth the RCMP are not called to do a murder/manslaughter investigation. That is why abortion not illegal, because there can be no crime against those that are not yet born alive. By the above definition, the anti-choicers would have a firm deadline and perhaps even legal standing on where to limit abortion (and then of course they would start trying to hammer back from that date). To me, the only point that matter is being born alive. After that I am quite happy letting medical ethics and the doctor – patient relationship take care of things. I’ve yet to see a case of a perfectly viable 39 week pregnancy being terminated for convenience in our wild west of no abortion laws.

I thought perhaps I misread the post, so I reread it several times. It is stated as fact that a fetus does not have an EEG. There is no fetus age given when saying there is no EEG. That must mean that for the entire typical nine month pregnancy there is no measurable brain activity. So are brain waves created during child birth? Maybe when the doctor smacks your backside?

If we are going to go by the American interpretation, measurable brain activity starts around week 25ish.
The Canadian interpretation is as Bleatmop said –
It also the case that, in my opinion, best services the needs of women and their rights.

I am not arguing the abortion subject in entirety. There would be no point in giving my views on that. It was just that on the surface the EEG argument made no sense to me, so I wanted clarification.

A quick explanation would be as follows –
You can’t kill something that isn’t alive in the first place – no brainwave = not alive by medical, legal and scientific standards.
That would be the thrust of the poster.
Probably not. But your honest inquiry is always welcome here.

The posting is saying that a fetus which has not yet developed brainwaves is the same as a person in a coma where brainwaves have ceased..
The person in a coma has no hope of living, because to date no one has.ever recovered from that state. The fetus if allowed to continue developing, will live.
My point is that what ever the legal and other arguments about abortion are, this EEG comparison is weak.

To further the point of the original article I would like to point out that having a heartbeat most certainly does not mean you are alive. All we have to do is look at the evidence. To that evidence, we have Dick Cheney. Dick Cheney has no pulse. He has no functioning heart. He doesn’t have a complete heart bypass and a pump that is circulating his blood. So what does this make Dick? I don’t know. Half cyborg half zombie maybe? Either way, there does seem to be the spark of life in him and he most definitely does not have a heart beat.
